1. DEFINITIONS

1.1. Account is a functional part of the Website through which the registered Buyer gains access to the extended Services and functions of the Website.

1.2. Data is a common name for Personal and Statistical Data.

1.3. User's consent (hereinafter referred to as the "Consent") is a voluntary, specific, informed and unambiguous expression of will in which the User agrees to the terms of Data processing through a statement or an explicit positive action.

1.4. Buyer is any individual or legal entity that purchases Digital Items by using the Website.

1.5. Guest is any individual who uses the Website but does not make a purchase of Digital Items.

1.6. Seller is any individual or legal entity that sells Digital Items on the Website on the basis of an agreement with the Company.

1.7. User is a common name for Guest, Buyer and Seller.

1.8. Digital Item is a file in electronic form posted on the Website and purchased by the Buyer.

1.9. DXF4YOU (hereinafter referred to as the "Company" or "DXF4YOU") is DXF4YOU 80664 LLC (address: 13500 W HALLANDALE BEACH BLVD, STE 191, HOLLYWOOD, FL 33023), a company registered in the jurisdiction of the United States, which provides the Services to the User.

1.10. DXF4YOU Company Website (hereinafter referred to as the "Website") means a web page or a group of web pages on the Internet located at https://dxf4you.com/, through which the Company provides Services to the User.

1.11. Personal data is any information that is in the public/private access that allows you to directly or indirectly identify the User. For example, name, surname, phone number, IP address.

1.12. Statistical data is any information that is publicly available and directly or indirectly related to the User.

1.13. Services are the implementation by the Company of an algorithm of actions for the sale of the Digital Items to the Buyer and the provision of additional information to the User about the Digital Items.

1.14. Third Party - means a natural or legal person, government agency, commercial institution or body other than the Company, Controller, Operator and User.

1.15. Controller is any natural or legal person, state body, institution or other body that independently determines the purposes and means of processing Personal Data.

1.16. Operator means any natural or legal person, government agency, institution or other body that processes Personal Data on behalf of and on behalf of the Controller.

2.2. The Company acts as the Controller in relation to the processing of Personal Data that the Company receives in the course of providing the Services, and the Company's employees act as the Operator in relation to the processing of Users' Personal Data.

2.3. The Company is not responsible for the processing of Data by any Third Parties that are not controlled or owned by DXF4YOU.

 

3. PERSONAL AND STATISTICAL DATA

3.1. DXF4YOU may receive the following Personal Data about the User:

3.1.1. full name;

3.1.2. contact phone number;

3.1.3. password;

3.1.4. payment data - solely for receiving payment/refund/replacement of the Digital Items;

3.1.5. e-mail.

3.2. DXF4YOU may receive the following Statistical Data about the Seller:

3.2.1. company data: name, legal address, type of business, country of registration and operation, IBAN, field of activity, information about employees and management, etc;

3.2.2. registration/tax number;

3.2.3. contact information: phone, e-mail, etc;

3.2.4. payment/bank details, solely for the purpose of receiving payment for the Services;

3.2.5. publicly available data on employees.

3.3. DXF4YOU may receive Publicly Available Statistics about the User that are necessary for the provision of the Services.

3.4. The Company may collect Data during communication with the User received through social networks, messengers, e-mail, telephone conversation. In this case, such data will be processed in accordance with this Privacy Policy.

3.5. The Company does not collect or process sensitive Personal Data of the User, such as race or ethnicity, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, information about health, sex life or sexual orientation.

3.6. During the provision of the Services, the Company may receive Data on the User's language of communication and such Data will be processed in accordance with this Privacy Policy.

3.7. The Company may process the Data that the User leaves when using the feedback form posted on the Website and/or the Data posted in the Account, in which case this Data will be processed in accordance with this Privacy Policy.

3.8. The Buyer may leave any Data in the review of the Digital Items, and the Buyer shall be aware that such Data will be publicly available and may be used by any Third Party, and the Company shall not be liable for any use of the Buyer's Data posted by the Buyer in the reviews.

3.9. All payment transactions carried out during the placement of an order through our services are processed by PayPro Global Inc., which acts as the official authorized reseller and payment service provider. PayPro Global Inc. is the data controller with respect to payment-related personal data in accordance with the General Data Protection Regulation (GDPR) and the applicable United States data protection laws. DXF4YOU does not collect, store, or have access to any Buyer’s payment information (including, without limitation, the bank card number, CVV code, or any other financial data). All such information is processed solely by PayPro Global Inc. in compliance with applicable security requirements. Such data will be processed in accordance with the PayPro Global Privacy Policy, available at: https://docs.payproglobal.com/documents/legal/privacypolicy.pdf.

3.10. The Company may receive limited information regarding the Buyer’s transactions from PayPro Global Inc. through automated technical means of data transmission (such as an API or other server notifications) solely for the purposes of verifying payment, confirming the order, and granting the Buyer access to the relevant digital file.

3.11. When using the Site or receiving the Services, DXF4YOU may automatically collect the following User Data:

3.11.1. IP address;

3.11.2. setting the time zone and language;

3.11.3. operating system, device type, and screen resolution;

3.11.4. the country where you are located;

3.11.5. data about your visit, including full URL information, route to and from the Site (including date and time), data loading errors, length of time spent on certain pages, page activity (such as scrolling and mouse movement, clicks), methods used to exit the page and phone numbers.

3.12. DXF4YOU has the right to collect and receive Data in this way:

3.12.1. during the provision of the Services;

3.12.2. during the sale of the Digital Items;

3.12.3. during registration/authorization;

3.12.4. during communication with the User;

3.12.5. when interacting with DXF4YOU employees by exchanging emails/messages;

3.12.6. during the monitoring and evaluation of the User's actions to detect and prevent fraud;

3.12.7. during the User's stay on the Website;

3.12.8. when using log files, cookies, and other tracking technologies;

3.12.9. via messengers and social networks.

3.13. The Company has the right to use Personal and Statistical Data for the following purposes:

3.13.1. provision of the Services;

3.13.2. for the sale of the Digital Items;

3.13.3. to ensure the Company's security;

3.13.4. to administer the Account;

3.13.5. for the Company's administration and internal operations, including troubleshooting, data analysis, and testing;

3.13.6. to improve the Company's navigation;

3.13.7. communication with the User;

3.13.8. responding to requests from law enforcement agencies;

3.13.9. to initiate responses to legal claims, investigations, or disputes with you.

3.14. Advertisers or other partners. Online Advertisers or Third Parties may share Data and information about you to evaluate or improve the effectiveness of advertisements on DXF4YOU or to better determine the type of advertisements displayed to you on the Site.

3.15. The Company's Blog may contain advertisements from the Google service, which may display content determined by the Google service, i.e., the Site may contain advertisements from independent suppliers and advertising networks. Such ads are displayed through the use of Google advertising cookies and the Company may display advertisements from Google based on information about previous visits to our Site by Users. Each User can disable the display of personalized ads by going to the Google advertising settings page. The User may prohibit the use of cookies by an independent vendor to serve ads by visiting www.youradchoices.com.

 

4. TRANSFER OF PERSONAL/STATISTICAL DATA

4.1. DXF4YOU may transfer Data to entities with which the Company cooperates in the sale of Digital Items and the provision of Services:

4.1.1. PayPro Global Inc. payment service. Is used for processing payments, issuing refunds, calculating taxes, and handling financial claims.

4.1.2. Contractors and employees. The Company may transfer Data to other persons with whom the Company enters into cooperation, including legal and tax advisors, as well as persons providing accounting, logistics, marketing and IT services.

4.1.3. Counterparties. The Company may disclose or transfer Data in the following transactions: acquisition or merger, financing, corporate reorganization, joint venture, including sale of assets or bankruptcy.

4.1.4. Service Providers. The Company may transfer Personal Data to the Company's service providers. In this case, the Company's service providers process Personal Data in accordance with the terms of this Privacy Policy.

4.1.5. Courts, law enforcement agencies and government authorities. The Company has the right to transfer Data in the event of fulfillment of any legal obligations, including by court order.

4.5. It is your sole decision whether to use the Company's Services. As the Company is registered in the United States and uses technical infrastructure in the United States to provide the Services, the Company may transfer Data to the jurisdiction of the United States as such transfer of Data is necessary to provide the Services. 5. USER CONSENT

5.1. One of the following actions of the Buyer means Acceptance of the terms of this Privacy Policy:

5.1.1. receiving the Services;

5.1.2. purchase of the Digital Items;

5.1.3. providing active Consent in the form of placing a marker in a free field (checkbox);

5.1.4. registration on the Website.

5.2. The Guest's stay on the Website means his/her consent to the terms of data processing, which the Company may receive in the form of placing a marker in a free field (checkbox).

5.3. By agreeing to the terms of this Privacy Policy, the User agrees to:

5.3.1. automatic collection and processing of its Data by the Company;

5.3.2. use and processing of its Data in accordance with the terms of the Privacy Policy;

5.3.3. providing the Company with additional information and Data upon its request;

5.3.4. processing of the Data during the purchase of the Digital Items;

5.3.5. processing of its payment details by the payment service/bank in accordance with the terms of this Privacy Policy;

5.3.6. transfer of its data to third-party services/contractors in accordance with the terms of this Privacy Policy;

5.3.7. use of the Data by the Company to represent the interests of the Buyer.

5.4. The Company reserves the right to obtain the Buyer's Consent using a pop-up form. The pop-up form may contain the Consent form in the form of a checkbox.

 

6. STORAGE AND PROTECTION OF PERSONAL/STATISTICAL DATA

6.1. The Company uses all necessary security and protection measures for the Data to ensure its confidentiality and prevent loss or unauthorized disclosure.

6.2. The Company protects the User's Data with the help of technical means and administrative measures designed to reduce the risks of illegal or unauthorized access, destruction, loss, alteration, disclosure or use of the Data.

6.3. To protect the Account, the Guest shall carefully select a password and not disclose his/her password details to any Third Party.

6.4. In the course of providing the Services, the Company uses the reCAPTCHA Enterprise feature - to combat spam, fraud and abuse, reCAPTCHA Enterprise collects Software and Hardware Data, including device and application data, and sends it to Google for the purpose of operating, maintaining and improving the reCAPTCHA Enterprise feature, as well as for general security purposes. Your use of reCAPTCHA Enterprise is subject to Google's Privacy Policy and Terms of Service.

6.5. DXF4YOU has the right to store User Data for 3 (three) years after the termination of the relationship in such cases:

6.5.1. for statistical accounting;

6.5.2. if the applicable law requires their storage;

6.5.3. if the Data is necessary for the conduct of business;

6.5.4. for marketing analytics.

6.6. If the User sends a request for deletion of his/her Personal Data, the Company deletes it permanently and does not store it under any circumstances.

6.7. In case of loss and/or unauthorized disclosure, the Company takes the following actions:

6.7.1. notifies the User within 24 hours of the loss/unlawful disclosure;

6.7.2. take actions as soon as possible to minimize losses from the loss and/or unlawful disclosure of the Data;

6.7.3. conducts an audit of the security of Data processing.

 

7. GROUNDS FOR PROCESSING PERSONAL/STATISTICAL DATA

7.1. DXF4YOU processes the Data on the following legal bases:

7.1.1. User's consent;

7.1.2. provision of the Services;

7.1.3. sale of the Digital Items;

7.1.4. registration/authorization on the Website.

7.2. In cases where the basis for processing the Data is your Consent, you have the right to withdraw it at any time. To withdraw your Consent, you can send a request to the following e-mail address: info@dxf4you.com. In case of withdrawal of your Consent, the Company has the right to stop providing the Services and terminate all relations with you. If the Consent is withdrawn, your Data will be permanently deleted.

7.3. The Company undertakes to stop processing the Data within 15 (fifteen) business days from the date of receipt of the withdrawal of the Consent.

 

8. JURISDICTION OF THE EUROPEAN UNION AND THE EUROPEAN ECONOMIC AREA

8.1. When processing Personal Data, DXF4YOU grants the User the following rights in accordance with the General Data Protection Regulation:

8.1.1. Right of access. The User may directly contact us to access the Personal and Statistical Data we hold about him/her, as well as any information.

8.1.2. The right to delete. The User has the right to delete Personal and Statistical Data about himself/herself. In this case, Personal and Statistical Data will be permanently deleted.

8.1.3. The right to data portability.We may transfer Personal and Statistical Data to Third Parties as requested by the User.

8.1.4. The right to rectification. The User has access to Personal and Statistical Data that needs to be updated, corrected and supplemented at any time.

8.1.5. The right to object.The User has the right to object to the processing of their Personal and Statistical Data at any time.

8.1.6. Automated individual decision-making, including profiling.The User has the right not to be subjected to a decision based solely on the automated processing of his/her Personal and Statistical Data, including profiling, which has legal consequences for him/her or in a way that significantly affects him/her.

 

9. US JURISDICTION

9.1. Rights granted to US residents:

9.1.1. Right of access. The Privacy Policy lists the User's Personal Data. The User may contact us directly to request access to the Personal Data we hold about him/her.

9.1.2. The right to erasure. The User has the right to delete Personal Data about himself/herself, in which case it will be deleted permanently.

9.1.3. The right to rectification. The User has access to Personal Data that needs to be updated, corrected, supplemented at any time.

9.1.4. The right to data mobility. We may send Personal Data to third-party organizations at the request of the User.

9.1.5. The right to object.The User has the right to object to the processing of Personal Data at any time.

9.1.6. The right to withdraw the Consent.The User has the right to withdraw his/her Consent to the processing of Personal Data at any time, in which case the Company has the right to stop providing the Services to him/her.

9.2. The Company does not support Do Not Track ("DNT"), as required by the California Online Protection Act (CalOPPA).Do Not Track is an option you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting your web browser's settings page.

9.3. 10. JURISDICTIONS OF OTHER COUNTRIES

10.1. The Company makes every effort to legally process Personal and Statistical Data in accordance with international standards.

10.2. This Privacy Policy sets out the main provisions of the law regarding the processing of Personal and Statistical Data.

10.3. Unfortunately, we cannot specify the legislation on the processing of Personal and Statistical Data in each jurisdiction of the world.

10.4. The terms of this Privacy Policy describe the basic rights of the User provided for by the main provisions of the leading legal acts governing the processing of Data.

11. SUBMITTING A REQUEST

11.1. If the User believes that his/her rights have been violated during the processing of the Data or if the User is concerned about the methods and means of processing the Data, the User has the right to lodge a complaint with a data protection supervisory authority. The User, depending on the circumstances, shall file a complaint with the supervisory authority at the place of his/her registration, residence, employment or with the supervisory authority of the country in which the User is a resident. To familiarize yourself with the supervisory authorities, please use the list provided.

11.2. The User has the right to submit a request to the Company if he/she believes that his/her rights have been violated by sending a request to the following e-mail address: info@dxf4you.com.

11.3. The User's request must contain accurate information about the requirements to the Company. If the request does not specify the exact requirements, DXF4YOU has the right to refuse to fulfill the request.

11.4. We will not be able to respond to your request or provide you with the Data if we cannot confirm your identity and/or confirm that the Data belongs to you. In case of receipt of a request with inaccurate information and/or in case of impossibility to confirm the identity of the User, DXF4YOU has the right not to process the received request and contact the User for clarification. In case of receiving a response to the Company's request for clarification of the content of such a request, the User shall provide a corrected request or submit a new request within a reasonable time.

11.5. DXF4YOU shall respond to the request or fulfill the conditions set forth in the request within fifteen (15) business days from the date of its receipt.

 

12. RESPONSIBILITY

12.1. The Company informs the User that Personal and Statistical Data may be used to provide the Services, and in case of disagreement with this, the User has no right to receive the Services.

12.2. The Company shall not be liable if the User provides inaccurate Personal and Statistical Data, including the inability to receive the Services.

12.3. DXF4YOU shall not be liable for any damages caused to the User as a result of the use of his/her Data by a Third Party without his/her knowledge, including third-party services (partners, payment systems, web analytics services, etc.), as his/her Data is processed in accordance with the privacy policies of such services.

12.4. In case of violation of the terms of this Privacy Policy by the User, the Company has the right to unilaterally and without notice to the User to apply the following sanctions to the User:

12.4.1. suspend access to the Company's functions;

12.4.2. delete the Account and terminate the Services.

12.5. The Company may link to other websites or services. The processing of Personal Data on these websites and services is not governed by the terms of this Privacy Policy, and the Company cannot be responsible for the processing of User Data by third-party websites and services.

12.6. DXF4YOU is not responsible for:

12.6.1. loss of Personal and Statistical Data in the event of a hacker attack, hacking of the Company's software, illegal actions of Third Parties, as well as actions that violate the terms of the Privacy Policy;

12.6.2. impossibility of providing the Services or poor quality of the Services in case the User provides inaccurate Personal and Statistical Data or any other information;

12.6.3. Data published in reviews;

12.6.4. providing false information by the User.

12.7. Unfortunately, the transmission of information over the Internet cannot be completely secure. Although we make every effort to protect the Data, we cannot guarantee a secure process of Data transmission to the Company. In this regard, you are solely responsible for any failures in the transmission of your Data to the Company.

 

13. ADULT POLICY

13.1. The Services are intended for individuals who have reached the age of majority in accordance with the laws of such person's jurisdiction. DXF4YOU does not process Personal and/or Statistical Data of individuals under the age of majority.

13.2. DXF4YOU does not purposefully verify the age of the User and does not verify whether such person has reached the age of majority or the age of consent, in accordance with the jurisdiction of such person.

13.3. DXF4YOU has the right to delete the Data of a person under the age of majority without warning and without any consequences for the Company, as well as to terminate the provision of the Services to such person.

14. CHANGE OF PRIVACY POLICY

14.1. We have the right to change this Privacy Policy from time to time to ensure the security of the Data and to comply with the laws of the State of Florida, USA.

14.2. The User should familiarize themselves with the new terms of the Privacy Policy and DXF4YOU is not responsible if the User has not read the new terms of the Privacy Policy.

14.3. DXF4YOU will update the date of the current version of the Privacy Policy in the "Updated" line at the top of the document.

14.4. Our electronic copies of the Privacy Policy are considered to be true, complete, valid, legally binding and in effect at the time of your visit to the Company.
